These Terms and Conditions (“Terms”) govern your use of drivarautoparts.com and any purchase you make through it. Drivar Auto Parts is a trade name of Commerce Foundations, LLC, a Florida limited liability company located at 4781 N Congress Ave #1279, Boynton Beach, FL 33426 (“we”, “us”, “our”). By placing an order or using this site, you agree to these Terms.
1. Orders and acceptance
Submitting an order is an offer to purchase. A confirmation email acknowledges receipt of your order; it is not acceptance. We may limit quantities, or refuse or cancel any order, including after confirmation, for reasons such as pricing or description errors, stock shortages, suspected fraud, or restrictions imposed by our suppliers. If we cancel an order you have already paid for, we will refund it in full.
2. Pricing and availability
Prices are shown in U.S. dollars and may change without notice. Availability is not guaranteed and inventory is held across multiple supplier warehouses. Despite our efforts, listings may contain typographical or data errors. Where a price or description is incorrect, we may correct it or cancel the affected order and issue a refund.
3. Vehicle fitment and compatibility
Fitment data, vehicle selectors and compatibility notes on this site are supplied by manufacturers and distributors and are offered as a guide only. You are responsible for confirming that a part suits your specific vehicle, including its trim, engine and production date, and for verifying the manufacturer part number before ordering. If you are unsure, contact us before you buy. We are not responsible for labor charges, downtime, towing, or other costs arising from a part that does not fit or that was ordered in error.
4. Payment
Card payments are handled by our payment processor. We do not store full card numbers on our servers. By submitting payment details you confirm you are authorized to use the payment method. Applicable sales tax is calculated at checkout where required.
5. Shipping and delivery
Delivery estimates are estimates, not guarantees. Orders may ship from more than one warehouse and arrive in separate shipments. Oversized or heavy items may ship by LTL freight, which can require a delivery appointment and a signature. Please inspect your shipment on arrival, note any visible damage on the delivery receipt before signing, and report damage or shortages to us within 48 hours of delivery so we can file a claim with the carrier.
6. Returns, refunds and cancellations
You may request a return within 30 days of delivery using the Return Request option on a completed order in your account. Items must be unused, uninstalled and in their original packaging with all included materials. Return shipping is paid by the buyer and deducted from the refund, except where the item arrived damaged, the wrong item was sent, the item is defective, or the item was not as described, in which case we cover return shipping. Original outbound shipping is refunded when an entire order is returned. Refunds are issued to the original payment method after the returned item has been received and inspected. Special order, custom and hazardous items may be non-returnable where our supplier does not accept them; we will tell you before you ship anything back.
7. Warranties
We are a reseller, not a manufacturer. Products carry only the warranty offered by their manufacturer, and we will pass along warranty information and assist with claims where we can. To the fullest extent permitted by law, products are otherwise provided without warranties of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
8. Installation and intended use
Parts should be installed by a qualified technician in line with the manufacturer’s instructions. Certain products are sold for off-road or competition use only and may not be legal for use on public roads. You are responsible for complying with all federal, state and local laws, including emissions regulations. We are not liable for damage, injury or loss resulting from improper installation, modification or use.
9. Your account
If you create an account you are responsible for keeping your login details secure and for activity that takes place under your account. Tell us promptly if you believe your account has been used without your permission.
10. Acceptable use
You agree not to use this site to break the law, to scrape or copy our catalog data in bulk, to interfere with the site’s operation or security, or to place fraudulent or resale orders that breach our suppliers’ terms.
11. Intellectual property
The design, text and layout of this site belong to us or our licensors. Manufacturer names, part numbers, logos and trademarks are the property of their respective owners and are used only to identify the products we sell. Their use does not imply any affiliation or endorsement.
12. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim connected with a product or an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential damages, including labor costs, towing, loss of use, lost profits or vehicle downtime.
13. Indemnification
You agree to indemnify and hold harmless Commerce Foundations, LLC and its officers and employees against claims, losses and expenses arising from your breach of these Terms or your misuse of a product.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. If a dispute arises, please contact us first so we can try to resolve it directly. Any claim that cannot be resolved informally will be brought exclusively in the state or federal courts located in Palm Beach County, Florida.
15. Changes to these Terms
We may update these Terms from time to time. The version posted on this page when you place an order is the version that applies to that order.
